The War On Brown People

As if Bush's violating posse comitatus by taking the National Guard away from the governors of our states wasn't outrageous enough (and isn't it interesting that none of the Neo-Confederate "states' rights" advocates are making so much as a peep in protest thereof?), this true tale ought to give people pause:

The last time the U.S. military posted troops on the border near this tiny cluster of farms and ranches, an 18-year-old goat herder was shot to death.

Hardly a day passes that Esequiel Hernandez Jr.'s family and neighbors don't think of May 20, 1997, the day a Marine corporal shot and killed him.

With President Bush considering plans to deploy National Guard troops along the Mexican border, Hernandez's family is worried that other border residents or even his nephews, who tend goats along the same rugged West Texas desert where he was killed, could be the next victims.
But of course, killing brown people is part of the plan. That's what justifies taking away our rights, as far as the Neo-Confederates are concerned.

and the national guard is not subject to the posse comitatus act. and the militia act put the national guard under the federal govt. ever wonder how wilson got all those folks to fight world war one? and what's the difference between having the navy/coast gurad protecting shores, the air force the skies and the national guard the ground?

oh, you also found the part where it says something like except where authorized by congress or the constitution (meaning "not subject"). so don't you worry your pretty little head. the president won't do anything with the national guard without congress voting for it... before they vote against it. and put down the cocoa puffs and step away from the keyboard.

n 1867, the Congress suspended the southern states' right to organize their militias until a state was firmly under the control of an acceptable government. The U.S. Army was used to enforce martial law in the South during Reconstruction. Expansion of the military's role in domestic life, however, did not occur without debate or response. Reaction to the use of the Army in suppressing labor unrest in the North and guarding polls in the South during the 1876 election led to congressional enactment of the Posse Comitatus Act in 1878. Designed to limit the president's use of military forces in peacetime, this statute provided that: "...it shall not be lawful to employ any part of the Army of the United States... for the purpose of executing the laws, except on such cases and under such circumstances as such employment of said force may be expressly authorized by the Constitution or by any act of Congress..."

Please find me the exact Constitutional cite and/or act of Congress that lets GW Bush get away with using the National Guard as a border patrol without asking the states' permission first.

Don't worry. I'll wait.

Meanwhile, what do you think of the idea that companies like Verizon (the parent of UUNet) may have provided your phone and e-mail records to the NSA -- without asking the NSA to obey the law by going through the FISA court first? Or is it OK because it's Bush's people at NSA that are doing it?

Hey, why should q bother to deal with facts when he can just come out with ignorant, unsourced one liners?

There is an interesting bit of law and history, which I came across during the Administration's crimes against New Orleans. It is permitted to use naval forces, including Marines, for peacekeeping purposes. It is the Army that is forbidden.

The use of the Air Force is forbidden by Posse Comitatus. So--since he never completed his service-- George Bush could not be called to active duty and sent to patrol the border from Laredo to Columbus.

He'd have to be sent to Fallujah.

"The Guard will assist the Border Patrol by operating surveillance systems analyzing intelligence installing fences and vehicle barriers building patrol roads and providing training. Guard units will not be involved in direct law enforcement activities. That duty will be done by the Border Patrol."

Looks like Bush has gone all squishy soft and won't be The Decider as to whether Posse Comitatus is the law of the land or not.

Everything PW has said is accurate.

1. The U.S. did (in contravention of posse comitatus) post troops on the border, leading to a tragic, senseless death.

2. Bush has proposed posting National Guard on the border, apparently in total disregard for the Posse Comitatus law.

3. People are rightly concerned that there will be more senseless shootings.

4. (a) Your statement that the National Guard is not subject to Posse Comitatus is false.
(b) Your failure to admit it makes it clear it was a lie.
(c) Your attempt to continue to cover up your lie with more baloney makes it clear you have no honor.

Exactly how deep of a hole were you digging for yourself?
